Sawcliffe Manor Rentals

HOUSE RULES

  1. Music

    1. Playing music inside the Manor House and/or hosting dance parties inside the Manor House is strictly prohibited. 

    2. Sawcliffe Manor’s Giant Party Yurt must be hired as an additional venue for those guests who wish to host a party with music and dancing. 

    3. Please keep noise to a respectful level for our neighbours. Loud music may be played until 11.30pm. Post 11.30pm ambient music at a respectable volume may be played at our discretion. 

    4. Unless we expressly consent in writing, professional grade sound systems must not be used and music speakers must not exceed a volume of 85DB at any time.

    5. Guests of Sawcliffe Farm must respect outdoor noise levels between 5pm and 8pm. As we have spa facilities on site, we ask that noise is kept to a minimum between this time and no loud music, shouting or screaming is permitted. 

  2. Care of the Property and Environment

    1. To help us protect and maintain the historical features of the ancient Manor House and our family home, we ask that guests please do not: 

      1. wear fake tan or stiletto heels inside the Manor House as this damages our floors and bathrooms;

      2. use tape, bluetack or any other adhesives to fix decorations to walls, furniture or light fittings during your stay;

      3. take or remove any of our personal belongings, fixtures or fittings from the Manor House. If you move any furniture around during your stay, please move it back to where you found it on your departure;

      4. open any private closets which are locked or marked ‘private’.

    2. We care about the environment around us and so we have a total ban on the use of glitter – this is to prevent micro plastic pollution and to protect our livestock (who may ingest micro-plastics).

    3. Please leave the property as you find it. This includes washing and drying all dishes and kitchenware used, following our bin and recycling instructions and removing all food and any other personal items brought with you from the property. 

    4. Cans and bottles cannot be disposed of in the Manor House’s recycling or mixed waste. Guests must take all cans and bottles with them on departure – there is a local recycling point situated 8 minutes drive away from the Manor House. 

    5. Please do not dispose of any sanitary items, baby or wet wipes, inside the property's toilets (including composting toilets). Only toilet paper may be thrown inside toilets on the property. Sawcliffe Farm uses a septic tank system. Damage incurred from disposing of anything other than toilet paper inside the property's toilets will be leveraged from security deposit payments.

    6. Electrical devices that do not meet UK or EU safety regulation standards may not be used on the property. Damage incurred from using devices that do not meet UK or EU safety regulation standards will be leveraged from security deposit payments.

  3. Dogs

    1. Dogs must always be kept on a lead when outside. Dogs are not permitted in the fields on the Sawcliffe Farm estate. 

    2. Please pick up after your dogs.

    3. Dogs are not permitted on the beds in any of the properties. 

    4. Dogs must be announced prior to arrival. A dog fee of £30/night will be due per dog. Please note that failure to announce a dog prior to arrival, will result in an additional fee.

  4. Beds & Amenities

    1. Sleeping spaces will be prepared for the exact number of guests that have booked to stay. For example. 6 guests, 6 sleeping spaces, 16 guests, 16 sleeping spaces, 21 guests, 21 sleeping spaces.

    2. To add additional sofa-beds and bedding to your stay, please let us know. Extra bedding is £30/additional sofa bed.

    3. A selection of gift shop items and cosmetics are available to buy inside our properties. Please use the QR code provided to purchase items on site.

    4. Payment for items that have been removed from gift shop areas, but remain unpaid for at checkout, will be paid for via the main booking contact’s preauthorised security deposit.

      Fire Safety

  1. Smoking is strictly prohibited inside the Manor House and Giant Party Yurt. 

  2. Candles must not be lit inside the Manor House. Any candles or fires lit must not be left unattended. 

  3. No fire works or bonfires are permitted in any area of the property or accommodation. If you wish to book a supervised bonfire evening or fire work display please contact the customer services team prior to your stay. 

  4. You are required to follow all health and safety and fire risk advice during your stay.

  5. In the case of a fire alarm, guests must:

    • Leave the building immediately by following the fire escape routes – do not stay in your room! In the case of a power cut, follow escape route signage and emergency lighting. 

    • Once safe, call 999.

    • Not re-enter the building unless authorised to do so by a member of our customer services team or the fire service.

Farm Safety

  1. Guests are responsible for their own safety whilst on Farm property.

  2. Guests are not permitted to walk in the fields on the Sawcliffe Farm estate. You must keep to the tracks at all times. 

  3. Be aware of large moving farm vehicles such as tractors. They often cannot see you. please keep out of their way and do not stand in the way of a farm vehicle. 

  4. Guests are responsible for their dog’s behaviour whilst on Farm property. As there is livestock on the farm, dogs must be on a lead at all times and are not permitted in the fields on the Sawcliffe Farm estate.

  5. We will not accept liability for any accident, loss or damage to you, your dog or your property whilst you are on the Sawcliffe Farm estate, unless such loss, damage or accident is demonstrably due to our negligence or that of those for whom we are legally responsible.

  6. All farm buildings are strictly private and off bounds. 

Spa Safety

  1. Please follow all the Spa safety instructions at all times and safe bathing facilities provided.

  2. Guests will be provided with a water temperature reading prior to access to the Spa, which you are asked to consent to and sign as agreement to accepting the temperature.

  3. All guests must shower before entering the Spa. The shower is a fresh water shower.

  4. Unless expressly agreed otherwise with our customer services team, guests are permitted to enjoy the Spa for an allotted maximum time of 2.5 hours. 

  5. To respect the privacy of other guests on site, guests are not permitted to access the Spa area or walk through the Spa area outside of their allotted time. The Spa area is not exclusive and may be booked out by other guests staying in nearby accommodation

  6. Absolutely no glass or alcohol is permitted in the Spa at any time.

  7. Children under 5 are not permitted in the Spa. Children aged 5 and over are permitted to join their parents in a mini-spa session. Children are not permitted entrance into our ‘Full Spa Sessions’. Children aged 5-18 must be accompanied in the Spa at all times by an adult.

  8. Children must wear safe bathing equipment provided by the Spa team for the duration of their Spa session (e.g. non-slip shoes, arm floats). 

  9. For your own safety, please do not: 

    • touch the wood burner or restock the fire at any point;

    • lean on the windows or the window glass;

    • touch or remove the fire wood.

  10. Maximum of 6 guests in the hot tub at any one time. Do not get into the hot tub if you feel that the temperature of the hot tub is too hot. Please get out of the hot tub if you feel that you are overheating.

  11. Pregnant guests are not permitted to use the hot tub or ice-bucket facilities (for health reasons). 

  12. Guests with high or low blood pressure are strongly advised not to use the hot tub or ice-bucket facilities (for health reasons). 

  13. Guests must not enter the Spa if they are wearing fake tan.

  14. Please blow out any lit candles and close the doors of the Spa on your departure. 

  15. Please leave the Spa as you find it.

  16. We will not accept liability for any accident, loss or damage to you, your dog or your property whilst you are in the Spa, unless such loss, damage or accident is demonstrably due to our negligence or that of those for whom we are legally responsible.

By making a booking with Sawcliffe Manor Rentals, you agree to the following Terms and Conditions. 

OUR AGREEMENT WITH YOU

  1. THESE TERMS

    1. What these terms cover. These are the terms and conditions on which we will supply the accommodation to you.

    2. Why you should read them. Please read these terms carefully before you submit your booking to us. These terms tell you who we are, how we supply the accommodation to you, how you and we may change or end the contract, what to do if there is a problem and other important information. If you think that there is a mistake in these terms, please contact us to discuss.

  2. DEFINITIONS

The following definitions apply in these terms and conditions:

  1. “accommodation” means the property hired by you under the terms of this agreement;

  2. “agreement” is the contract which incorporates: (i) these terms and conditions; (ii) your booking confirmation; (iii) the documents referred to in clause 3.1 below; and (iv) anything else we agree with you in writing; 

  3. “party” refers to those persons named on the booking confirmation and any person added later who will be staying at the accommodation; 

  4. “We”, “us”, “our” or “Sawcliffe Manor” is Sawcliffe Manor Rentals, trading in partnership from Sawcliffe Manor, High Risby, Scunthorpe, DN15 0BH;

  5. “Writing” or “written” shall also include emails; and

  6. “You”, “your” or “lead guest” the contact point for the booking who must attend the accommodation booked.

  7. INFORMATION ABOUT US AND HOW TO CONTACT US

    1. By booking with us, you confirm that you agree to comply with and accept these terms and conditions and the following additional terms which we will provide to you:

      1. our House Rules;

      2. the Fire Safety Rules; 

      3. our Farm Safety Rules; and

      4. the Spa Safety Rules.

    3. How we may contact you. If we have to contact you we will do so by telephone or by writing to you at the email address or postal address you provided to us in your booking.

    3. YOUR USE OF THE BOOKING

    1. The accommodation that we advertise is offered for the sole purpose of holiday occupation and must never be occupied as your principal home, unless expressly agreed otherwise in writing by us.

    2. Accordingly you agree and accept that you are not offered any rights to the accommodation other than the right to occupy the accommodation as holiday accommodation for the period of your booking. No booking of any kind is an ‘Assured Shorthold Tenancy’ or protected under the Protection from Eviction Act 1977. 

    3. Our booking services with you are available for your personal, non-commercial use only. You are not allowed to re-sell our bookings or act as an authorised agent. This includes the advertisement, sale or gift of your booking (for profit or otherwise) or use it in connection with a competition, promotion, business and charitable or any other similar venture without our express advance written permission.

    4. WEBSITE DETAILS

    1. We aim to make sure that information provided about our accommodation and its facilities or services, is accurate and complete on the date given. Descriptions are intended to present a general idea of the accommodation and do not constitute any advice or recommendation by us.  

    2. Not all details of the relevant facilities can be included on our website. Furthermore, there may be small differences between the actual accommodation and its description. Occasionally, some facilities or services may not be available or may be restricted. If this happens, we will tell you as soon as reasonably practical after we become aware.  

    3. Where Wi-Fi is an advertised facility, its provision is subject to availability and network conditions. It may not be available 24 hours a day and is provided for pleasure, not for business purposes.  

    4. We cannot accept responsibility for any inaccurate, incomplete or misleading information about any accommodation or its facilities and services that we pass on to you in good faith, unless this was caused by our negligence. If we become aware that such information is not true, we will promptly correct it.  

    5. We cannot accept responsibility for any changes or closures to local services or attractions mentioned on our website.

    5. MAKING YOUR BOOKING

    1. How we will accept your booking. Our acceptance of your booking will occur when we email you with a booking confirmation, at which point a contract (our agreement) will come into existence between you and us. 

    2. If the accommodation is available and we have received all the relevant payments from you, we will send you an email confirmation of your booking as soon as reasonably possible. This email confirmation will show your booking details, the amount you have paid and the amount you still owe for the booking. If you do not receive a booking confirmation within 48 hours, please contact us immediately.

    3. We have the right to refuse any booking before we send you written confirmation. If we do this, we will tell you in writing and promptly refund any money you have paid to us. In this case we will have no legal responsibility to you.

    4. If you place your booking with us and we are unable to take the relevant payments due to an error with your card details, bank or any other issue, we will make attempts to contact you to let you know. If we are unable to contact you within three days from your first attempt to make the booking and still are unable to take the relevant payments due from you, we reserve the right to cancel the booking.

    5. Our agreement with you binds you (the person named on the confirmation), and all members of your party, including children. You must ensure that all members of your party are aware of, and accept all of the terms of this agreement. Our agreement continues in place until the last member of your party has left the accommodation, including any extension to your stay and for such time afterwards as may be necessary.

    6. Please check the details on the booking confirmation carefully. If any of the details are incorrect, or change, especially your address, you must inform our team as soon as possible. You must also ensure that you pay any amount required in accordance with the booking confirmation. If you do not pay the required amount when due, we will have the right to cancel your reservation and keep or claim your deposit (as it is a non-refundable booking fee). 

    6. PAYMENT AND PRICING

    1. Prices are kept under constant review, and prices may fluctuate throughout the day. We reserve the right to adjust the prices of accommodation. The price shown on your booking confirmation will not change.

    2. In relation to the Manor House, additional guests over and above a group of 16 guests booking via Airbnb, VRBO and other booking platforms with guest limits in place, will be charged as ‘extra guests’ at a cost of £80 per extra guest. The exact guest count will be prepared, for example, 16 sleeping spaces, for 16 guests. If a group would like to add sleeping beds, but not additional guests, the cost will be charged as 'extra beds', £30/additional bed. If a group would like to add additional guests to their booking, the cost will be charged as 'extra guests'. We do not accept day guests on the property. All guests visiting only for the day, aka. day guests, must be announced prior to arrival, and will be charged as 'extra guests', in accordance with the pricing above. The main booking contact is responsible for confirming the final guest count 15 days before checkin. After this time, guests cannot be removed from the booking. Additional guests can be added until a maximum of 24 hours before the checkin time. If 'extra guests' and 'day guests' accessing the property without prior approval, will incur a fee of £50 per guest per the number of nights booked.

    3. The lead guest is responsible for making all payments to us. We will ask you to pay a non-refundable deposit to secure your booking. The deposit payment will be required upon booking that equates to 25% of the total sum of your booking (being the total costs of the accommodation plus damage deposit (chargeable in accordance with clause 17.2) plus any extra charges relating to services to be provided during your stay). When you book, you must pay the deposit amount then due. You must pay by debit or credit card and we only accept payment in pounds sterling.

    4. A further 75% of the total sum of your booking (being the total costs of the accommodation plus damage deposit (chargeable in accordance with clause 17.2) plus any extra charges relating to services to be provided during your stay) will be due and payable within 30 days of the booking.

    5. The balance of the total sum of your booking (being the total costs of the accommodation plus damage deposit (chargeable in accordance with clause 17.2) plus any extra charges relating to services to be provided during your stay) will be due and payable 15 days prior to your arrival date.

    6. We must receive the full payment of the total cost of your booking 15 days prior to your arrival date. Failure to do so may result in your booking being cancelled with no refund.

    7. You can pay off the remaining balances of your booking either by calling us on by visiting the link in the balance payment reminder email.

    8. If you do not pay any payment due in relation to your booking by the appropriate date we are entitled to assume that you want to cancel your booking. In this case, your booking will be cancelled immediately and the provisions of clause 9 will apply. You may also need to pay additional charges and will also lose your deposit, as this is a non-refundable administration fee.

      7. CHANGING OR CANCELLING YOUR BOOKING

      1. You may change the date of your booking with us for any reason provided the change is made at least four months prior to your arrival date. It will not be possible to move your booking if your request to move the booking is made less than four months prior to your arrival date. A £60 administration fee shall apply to any change to your booking requested by you. 

      2. You may only move your arrival date once, to a date that is no more than 12 months from your initial arrival date, and this is subject to availability. Any further attempt to move your arrival date will entitle us to treat this as a cancellation with the relevant fees applying. 

      3. You must select your new arrival date within 30 days of making the request. If you do not inform of us within this time frame of your new arrival date, we will treat this as a cancellation and the relevant fees shall apply.

      4. Please note that any change of date and accommodation will be likely to involve a change in price of your booking and an amendment charge being payable. If your booking is more expensive, you will be required to pay any additional cost. You can transfer any deposits that you have already paid over to your new booking date. 

      5. You may cancel your booking at any time by writing to us at sawcliffemanorrentals@gmail.com or by messaging us on WhatsApp at 0034711020722. You will have to pay a cancellation charge based on the number of days before the arrival date of your booking that we receive notice, as shown in the table below. This means that if you have already paid the full balance of your total booking cost and then have to, or want to, cancel, we may be entitled to receive the payments we have received to cover the cancellation charge, or you may receive a refund of part of the cost. However, if you have not yet paid your total booking cost by the time of your cancellation, you may have to make a further payment to cover the cancellation charge:

        Manor House Bookings:

  1. For the purpose of the tables above, total accommodation cost means accommodation price plus any extra items charged by us such as charges for pets or cots, but not including the damage deposit or any administration fees charged by us for making any changes.

  2. You will be refunded 100% of any payments made in relation to damage deposits (charged in accordance with clause 17.2) if your booking is cancelled at any time prior to your arrival date. 

  3. If you give notice to cancel your booking at least 15 days prior to your arrival date and in accordance with this clause, you will be entitled to a 100% refund in relation to any payments made towards the following additional extras: hire of the Giant Party Yurt; hire of the Spa area; catering services provided by Sawcliffe Manor Rentals; archery; and axe throwing. 

  4. The following additional extra services are provided by external third parties and are therefore subject to their own cancellation terms: wine tasting; yoga lessons; catering services provided by external service providers and burlesque classes.

  5. You may not transfer your booking to any other person or party without our written prior consent.

  6. If any person(s) in your party needs to cancel, this will not affect the total cost of your booking.

  7. No refunds are payable in the event that you cut short your stay. 

    8. CHANGES BY US 

    1. We do not expect to have to make any changes to your booking. However, sometimes bookings have to be changed or mistakes have to be corrected. We have the right to do so.   

    2. If we do need to make changes, we will contact you by phone if reasonably possible in the case of a significant change or by email in the case of a minor change as soon as is reasonably practical. We will explain what has happened and let you know about the change. However, we will have no further liability to you.

    3. If we cancel your booking or are prevented from providing the accommodation you have booked, you may choose to: (i) accept alternative accommodation – you will have to pay any difference in price if the cost of the new accommodation is higher or be reimbursed the difference if the cost of the new accommodation is lower; or (iii) obtain a refund of the amount already paid by you for the booking. We will contact you to inform you of these options.

    4. Even if we have sent a written confirmation, we have the right to cancel a booking where there are reasonable grounds to believe that (i) it is not legitimate; (ii) you are likely to breach these booking conditions; (iii) information supplied by you in relation to your booking is incorrect and you have not informed us in a timely manner; (iv) you have behaved in a vexatious, abusive or unlawful manner to other guests or our staff. If we cancel your booking in these circumstances, we will tell you in writing and we will not have any legal or financial responsibility to you. 

    5. In addition to clause 9.4, we do not knowingly allow any guest to use or visit the accommodation who: (i) has an unspent criminal conviction; (ii) has an entry on a criminal register (including the sex offenders’ register); (iii) has any record of any order indicating antisocial behaviour, violence, abuse, public disorder or criminal damage or any other form of antisocial behaviour; (iv) is a convicted sex offender, subject to the notification requirements of the Sexual Offences Act 2003; or (v) is subject to a Risk of Sexual Harm Order or Child Abduction Notice. If you do not disclose this information about yourself or any other member of your party, and it later becomes known to us, we reserve the right to cancel your booking and require that you, and the other members of your party, leave the accommodation, without refund.

    6. We can also end a stay after the keys have been handed over, if the unreasonable behaviour of anyone in your party (including anyone invited into the accommodation by you) is likely to spoil the enjoyment, comfort or health of other guests, residents, neighbours or members of staff or where you or any member of your party (or anyone invited into the accommodation by you) has broken or is likely to break any of these booking conditions or any other terms and conditions applicable to the accommodation which you have been told about. If this happens, you will have to leave the accommodation immediately and no refund will be given. You may also be responsible for any costs we incur as a result of your behaviour.

    9. TERMS OF YOUR STAY

    1. Where the majority of the party is under 21 or includes any person(s) who are normally closely supervised, there must be sufficient capable and responsible adults over the age of 21, in the accommodation to provide adequate supervision for the party and each member of it. The lead guest will have overall responsibility for the whole party. The name and contact details of the lead guest will be confirmed on arrival at the accommodation.

    2. If the purpose of your booking is for a stag party, please call our team prior to submitting the booking to discuss availability. 

    3. If your booking is for a group of over 16 guests celebrating a special occasion, please call our team prior to submitting the booking to discuss availability. Our Giant Party Yurt must be hired as an additional venue for those guests who wish to host a party with music and dancing – if you do not wish to hire the Giant Party Yurt it is at our absolute discretion to either accept or reject the booking request. Playing music inside the Manor House and/or hosting dance parties inside the Manor House is strictly prohibited. Unless we provide prior written consent, professional grade sound systems must not be used.

    4. If we incur costs in providing assistance or supervision to your party we reserve the right to claim compensation from you in accordance with clause 17.

    5. We reserve the right to conduct security searches as a condition of entry to protect your safety and that of other visitors. We may conduct security searches of clothing, bags and vehicles, as determined by us in our reasonable discretion, including on entry and exit of the accommodation.

    10. PETS

    1. Dogs are permitted in certain types of our accommodation. Dogs must always be kept on a lead when outside. Dogs are not permitted in the fields on the Manor House estate. 

    2. Each dog must be properly supervised and must not be dangerous or a threat to anyone.

    3. We do not accept dogs listed under the Dangerous Dogs Act which includes: Pit Bull Terriers, Dogo Argentino, Fila Brasileiro and Japanese Tosa.

    4. We do not accept dogs in all of our accommodation, please contact our team prior to booking to discuss availability. An additional charge of £30 will apply per dog per night.

    5. If we, in our sole and reasonable discretion, consider your dog to be dangerous or to be causing a nuisance, harm or threat to anyone, or to be likely to do so, we may ask you to remove it from the accommodation (without refund or compensation) or have it removed to kennels at your expense. 

    6. No other pets are permitted.

    11. ARRIVAL

    You may arrive from 4pm on your arrival date - or a time otherwise stated in your rental agreement. 

    12. DURING YOUR STAY

    1. In order to ensure all of our guests have a pleasant stay, you must agree and adhere to the House Rules, Fire Safety Rules, Farm Safety Rules and Spa Safety Rules, which will be provided to you before your arrival.

    2. The lead guest is responsible for providing a copy of the House Rules, Fire Safety Rules, Farm Safety Rules and Spa Safety Rules to all members of the party and ensuring that all members of the party comply with such rules during the entire duration of your stay. 

    3. Failure to comply with the House Rules, Fire Safety Rules, Farm Safety Rules and Spa Safety Rules by you or any member of your party may result in you being asked to leave the accommodation without a refund and be charged a fine of up to £200 per rule broken. 

    4. Smoking (including e-cigarettes and vaping) is not permitted in any buildings (including the accommodation) but is permitted where indicated in certain outdoor areas.

    5. You are not permitted to allow contracted external providers of services (including but not limited to caterers, yoga teachers, masseurs, entertainers, musicians etc) to the accommodation during your stay. You are not permitted to hire external items such as inflatables, hot tubs, trampolines or similar. If you wish to book certain services or activities with us during your stay, please speak to our customer services team and we can arrange these for you.  If a group arranges for an external provider to provide their services on the property, without prior approval, a £200 fee will be added to their booking.

    6. We offer a supermarket delivery service for an additional fee of £30 where a member of our team will receive your pre-ordered shopping delivery at the Manor House and put this away for you prior to your arrival on your arrival date. This must be pre-booked and arranged with us to be delivered on the date of your arrival. Deliveries cannot be delivered to the Manor House outside of the pre-booked times. 

    7. You must not allow more people than the website states to stay overnight in the accommodation. You must not hold events (such as parties, celebrations or meetings) at the accommodation without our advance consent. If you do any of these things, we can refuse to hand over the accommodation to you, or can repossess it. If we do this, we will treat this as you cancelling the booking. In these situations you will not receive a refund of any money you have paid for your booking. We will not be legally responsible to you as a result of this situation (for example, for any costs or expenses you have to pay due to not being able to stay in the accommodation, such as the cost of finding alternative accommodation) and we are under no obligation to find any alternative accommodation for you.

    8. In submitting your booking to us, you confirm that you understand that:

      1. Sawcliffe Farm, the farm land and farm buildings are part of a working farm and are private property. These spaces are not included in the booking of the accommodation and are strictly off limits to guests;

      2. you are strictly only permitted to drive through the farm yard and along the farm drive from High Risby Road in order to access the Manor House by car;

      3. no party member is permitted to walk through the farm yard at Sawcliffe Farm or enter any farm buildings during your stay; 

      4. the Spa area at Sawcliffe Manor is a private and separate space that is not included in the booking of the accommodation and is off limit to guests unless booked separately. The Spa area is not exclusive and may be booked out by other guests staying in nearby accommodation; and

      5. there are other guests occupying nearby accommodation and that you will and will procure that the guests in your party will respect the privacy and quiet enjoyment of those other guests and our neighbours during your stay. 

    13. SECURITY AND LOST PROPERTY

    1. We will not accept liability for any accident, loss or damage to your cars or personal property during your stay unless such loss, damage or accident is demonstrably due to our negligence or that of those for whom we are legally responsible. 

    2. If you discover that any of your property has been left behind after your departure and this has been recovered by our customer services team, you can arrange for this to be collected from us in person or by your selected courier service. We will not be responsible for finding or forwarding any lost property on to you. 

    14. DEPARTURE

    1. You must vacate your accommodation by 1pm for bookings in the Manor house, or 11am for bookings in Hare Cottage, Plum Cottage, Rose Cottage and our Yurt, at the latest on your day of departure. Failure to vacate the property by the agreed checkout time will result in a late checkout fee outlined in your rental agreement.

    15. THINGS BEYOND OUR CONTROL

    1. We cannot take responsibility or pay compensation if we cancel or change your booking in any way because of events beyond our control. Neither can we accept any liability for any injury, loss or damage you suffer because of events beyond our control. Events beyond our control include, but are not limited to: warfare and acts of terrorism (and threat thereof), civil strife, significant risks to human health such as the outbreak of serious disease at the travel destination (including epidemics, pandemics and the ongoing effects of the Covid-19 pandemic) or natural disasters such as floods, earthquakes or weather conditions which pre vent you from travelling to the travel destination and/or make it impossible to travel safely to the travel destination or remain at the travel destination,  the act of any government or other national or local authority including port or river authorities, industrial dispute, labour strikes, lock closure, natural or nuclear disaster, fire, chemical or biological disaster, unavoidable technical problems with transport and all similar events outside our control.

    2. In the event of exceptional circumstances, we may need to cancel your booking. If this does occur, we will inform you as soon as is reasonably possible. We will offer to you one of the below options:

      1. a replacement booking to the same value as the one you had previously booked. However, if your new booking is more expensive, you will be required to pay any additional cost. Alternatively, if your new booking is a lower value than the one you had originally booked, we will refund you the difference; or

      2. a full refund, with all money returned to you in the same way you made your original payment.

    3. In all cases, except from personal injury or death, our liability to you for the total claims arising out of your booking with us is limited to the cost of your booking less any insurance, cancellation, amendment or separate charges.

    16. DAMAGE OR DESTRUCTION

    1. We are committed to ensuring we provide a safe environment for all of our guests. In order to continue to provide this, we require the lead guest to pay a damage deposit, as security, in the event of any damage caused as a condition of entry. You are responsible for all guests staying at the accommodation and the things they do (and do not do) even if you do not stay at the accommodation during the booking period.

    2. We will therefore charge a damage deposit of £1000, as set out in the booking confirmation, for any damages that may occur throughout your stay. An additional security fee of £150 will be charged to cover any damage caused in relation to the hire of the Giant Party Yurt. Your card will be refunded for these charges within 10 days of your departure date unless damage to the accommodation or that of our property are caused. This will include the right to recover any additional cleaning costs and any costs relating to damage or theft at the accommodation, or last minute purchases of additional services such as (but not limited to); food & drink, spa bookings, archery, axe-throwing, afternoon teas, pet fees, extra guest fees. Failure to make payment of the damage deposit in accordance with clause 7 may result in your booking being cancelled with no refund.

    3. We may also go into the accommodation at a reasonable time (and on reasonable notice) during your stay to check the state of things. Any damage to the accommodation could result in your booking being cancelled and your stay being prematurely terminated, with no refund. If there is an emergency, we can come into the accommodation without warning.

    4. If there is any damage to the property, yurt or gardens, or any breakages of glass or kitchenware etc, please tell the customer services team immediately so we may resolve this. Guests must report existing damage up to 5 hours after the arrival date check in time. Guests must report damage incurred during your stay before check out. Failure to report damage found during your stay on or before check out may result in a fine of up to £200. 

    5. You are responsible for and agree to reimburse to us all costs incurred by us as a result of any breakage or damage in or to the accommodation which is caused by you or any members of your party or any other persons invited into the accommodation by you. We can ask for an extra payment from you to cover any such costs. 

    6. We expect the accommodation to be left in a reasonably clean and tidy state on departure. If, in our opinion, additional cleaning is required, you will be liable to us for the cost of this cleaning. 

    7. You may need to check and sign an inventory of the accommodation and its contents on arrival at the accommodation. If you discover that anything is missing or damaged on arrival please notify us immediately.

    8. You may not use any electrical devices in the property that do not meet EU regulatory and safety standards. We can ask for an extra payment from you to cover any costs for damage incurred by the use of faulty devices, and those that do not meet EU regulatory and safety standards.

    17. CUSTOMER SATISFACTION

    1. If you should have concerns or queries during your stay, please make us aware as soon as possible. We will endeavour to assist you in any difficulties and resolve any concerns, in order for you to enjoy your stay.

    2. If you have any queries or concerns about our booking services, you must let us know immediately in writing and in any event before you travel. Unfortunately, we cannot accept any legal responsibility if you do not let us know what is wrong and allow us an opportunity to respond to you. If we are found to be at fault in relation to any service we provide, we will not pay more than the price of the booking (or the appropriate proportion of this if not everyone on the booking is affected), plus any reasonable expenses you cannot recover from elsewhere.  

    3. We do not exclude or limit what we will be legally responsible for if death or personal injury is caused as a result of our negligence or that of our employees whilst acting in their course of their employment, or for any criminal act we may commit. We cannot be held responsible for noise or disturbance which comes from beyond the boundaries of the accommodation or which is beyond our control. If we know about a problem before you arrive, we will contact you to let you know. We cannot be held responsible for the breakdown of mechanical equipment such as pumps, boilers, hot-tub filtration systems, nor for the failure of public utilities such as water, gas, internet connectivity and electricity. 

    4. You must tell us as soon as possible if you have any queries or concerns to give us the opportunity to put right anything that is wrong before the end of your stay.   

    5. Please note that we will not be held responsible for any matters that you were aware of throughout your stay and did not make us aware of. 

    6. Please note that you must make us aware of any prior damage discovered on the property within the first 3 hours of accessing the property, up to a maximum of 7 hours from the stated checkin time on your booking. After this time you will assume liability for damage and breakages on the property.

    18. OTHER IMPORTANT TERMS

    1. Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

    2. These terms are governed by English law and you can bring legal proceedings in respect of the products in the English courts. If you live in Scotland you can bring legal proceedings in respect of the products in either the Scottish or the English courts. If you live in Northern Ireland you can bring legal proceedings in respect of the products in either the Northern Irish or the English courts. 

    3. We must both act reasonably in selecting or agreeing any jurisdiction including any forum for dispute resolution. 

    4. Should any part of our agreement be deemed by law to be void, the remainder of this agreement will, if capable, continue in full force and effect. The headings in this agreement are included for convenience only and shall not affect its interpretation or construction.
